Werkloy (company name) (" Werkloy ", " we ", " us ") respects your privacy and takes the protection of your privacy seriously, which is why we manage this website and our services in accordance with the applicable privacy legislation, in particular the EU General Data Protection Regulation ("GDPR"). The purpose of this Privacy Statement is to give you a clear picture of how we use your personal data, the rights you have and the possibilities to exercise control over your data and the protection of your privacy.

Personal data that you provide to us or that we collect automatically

The personal data we collect includes:

  • Contact details and details about assignments and services, such as (company) name, company name, address, telephone number, e-mail address, specialism and other personal data that you voluntarily provide to us when you contact us or communicate with us. Werkloy also collects personal data from clients who place an assignment and from contractors to the extent that this data is necessary to make a 'match' with a potential client. This includes data such as profession and information about work and products and services;
  • Account details, such as username and password if you create an account with Werkloy;
  • Identification data Originating from identification documents of the Professional
  • Transaction and financial data, such as invoices, financial data entered into the system to utilize analytics functionality, invitations for assignments to contractors and proposals from contractors for assignments from clients;
  • Communication data, such as communication between client and contractor via Werkloy, participation in surveys or communication with Werkloy, for example if you contact our customer service or ask us a question, provide a response or submit a request;
  • Reviews and comments posted by users of Werkloy;
  • Descriptions of assignments posted by Werkloy users;
  • Automatically collected data, such as your IP address, browser type and operating system, application version and geographic location. We also collect and generate data based on your use of Werkloy, such as the pages you have visited, the pages you visit before and after your visit to Werkloy, the search terms you use, how often you use Werkloy and whether you are interested in using Werkloy more often.   • Social media login. To improve your user experience on our website, we offer the option to log in via your Google or Facebook account. If you choose to do so, you authorize us to collect personal data such as your name, email address, and external identification number. We may store this information for use as described in this statement and this information may be used to validate user data for social media login. The use of information collected by Google and Facebook is subject to the respective parties’ policies and our use of this information is subject to this privacy statement.
  • Telephone recordings. We may record telephone conversations for the purposes of quality control, internal training and evidence of contract formation. It is in our legitimate business interests to do so.

Personal data that we obtain from other sources

We use external sources to collect certain personal data. For example, the Chamber of Commerce to collect company data of contractors or external sources from which we can deduce whether a VAT exemption applies. We also collect technical information about the delivery of e-mails, SMS and push messages from sources such as Google Analytics and Amazon Web Services.

How Werkloy uses personal data

Werkloy uses your personal data for the following purposes:

  • You can visit our websites without providing any personal information. Each time you visit a website, the web server automatically saves a so-called server log file, which contains, for example, the name of the requested file, your IP address, the date and time of access, the amount of data transferred and the requesting provider (access data) and records the access. This access data is evaluated exclusively for the purpose of ensuring trouble-free operation of the website and improving our offer. In accordance with Art. 6, Para. 1, Sentence 1, Letter f GDPR, this serves to protect our legitimate interest in correctly presenting our offer, which prevails in the context of a balancing of interests. All access data will be deleted no later than seven days after the end of your visit to the website;

  • An external service provider provides us with the services for hosting and displaying the website and is therefore processing data on our behalf. These service providers are contractually obliged by us to exercise the same level of care in processing personal data as we do ourselves.
  • All data collected during the use of this website or in the forms provided for this purpose as described below are processed on our servers. Processing on other servers only takes place within the scope described here.
  • This service provider is located within a country of the European Union or the European Economic Area. Data processing takes place within the European Union.
  • Offering our services
  • The majority of our offers are only available if you register with us. Then you can, for example, place tenders, participate in tenders or submit evaluations. We ask for data that is necessary or recommended for use (e.g. execution of the tenders or the user relationship). This includes in particular your name, address and other contact information, such as your mobile phone number. In connection with the collection of data, we point out when information is mandatory. We use the data provided by you in accordance with Art. 6, Para. 1, Sentence, 1 Letter b GDPR to process the contract.
  • If you place a tender on Werkloy, we will give your contact details to the specialist you select after the tender to carry out the work. We will use the data you provide to process the contract in accordance with Art. 6, Paragraph 1, Sentence 1, Letter b GDPR.
  • Furthermore, the data may be used due to legal obligations, such as responding to official requests within the meaning of Art. 6, Para. 1, Letter c GDPR.
  • For professionals and service providers (contractors), Werkloy also stores a provider profile and payment information for the payment of user fees. Finally, information on the type and content of the tenders in which you have participated as a provider is stored. We also request copies of contractor evidence to verify individual information stored in the member profile, for example with regard to commercial or other registrations, permits or qualifications, or notification of freelance activity, the professional qualification certificate, the master's degree or comParable evidence. These documents are stored in electronic form for the duration of the membership or for the duration of statutory retention periods in accordance with Art. 6, (1)(b and c) GDPR.
  • After the contract has been fully processed or your member account has been deleted, your data will be restricted for further processing and deleted after the tax and commercial retention periods have expired, unless you have expressly consented to further use of your data or we reserve the right to use the data in a manner otherwise permitted by law and about which we will inform you in this declaration. Your member account can be deleted at any time and can be done by sending a message to the contact option described below or via a function provided for this purpose.
  • Identification and authorization Your personal data to verify your identity and give you access to our services. Our basis for this is the performance of the contract we have with you, compliance with legal requirements for identity verification (Art. 30 Digital Services Regulation) and compliance with our legal obligation to take appropriate security measures to protect the data we process. The legal basis for this is Art. 6(1)(b, c or f) GDPR.
  • Fraud prevention We process identification data from identification documents of the Professional for fraud prevention. This is in accordance with the Professional. The legal basis for this is art. 6(1)(a)GDPR;
  • Protection of our service and users We process the information in communications between contractors and clients on our website and services to understand whether and to what extent a refund request from a contractor is valid, or to determine whether a user has violated our Terms and Conditions, for example by using abusive, insulting or offensive language when communicating with another user. The basis for this is Art. 6(1)(f) GDPR.
  • Improving our website and services We analyze information about how you use our website and services in order to improve the user experience for all website visitors and users of our services. This information includes research data, communication data, and statistics or conducting and analyzing surveys that you choose to participate in to improve our services. It is our legitimate business interest to conduct research and analysis regarding the performance of our services and to better understand how those services are used, so that we can understand and improve any issues with our services;
  • Customizing your experience We use your personal information to provide you with a personalized experience with our services. We do this by, for example, offering you interactive or personalized elements that are tailored to your interests. It is our legitimate business interest to offer you a service that is as closely aligned as possible with your interests;
  • Communication We use your personal data to communicate with you, for example when you contact our customer service, send us an email or request us to exercise a right. We also use your personal data to contact you, for example, if we want to inform you about changes to our services or terms and conditions. It is in our legitimate business interest to inform other users or other parties interested in our services about successfully completed jobs.
